Italian restaurant hit with £25,000 demand over dismissal

The owners of an Italian restaurant in Scotland must pay £25,000 in compensation after an employment tribunal ruled that a chef did not resign but was sacked.

The tribunal sitting in Edinburgh ruled that statutory procedures were not complied with and that Salvatore Trano, head chef at Ristorante Italia in Kelso, had been unfairly dismissed.

Evidence was given that relations between owner Antonio Crolla and Trano had broken down, resulting in Trano being given a letter giving him four weeks notice.

But the same evening after two customers complained about their meal there was a further dispute between the two men and Trano walked out and did not come back.

Trano then claimed that he had been sacked but Crolla said that he had resigned and walked out.

The tribunal concluded that Trano had been dismissed and that it then became unfair dismissal as statutory procedures had not been followed.
